How a payment takeover works with us
Most people call us because they've already decided they're done with the house. Maybe the payment went up when taxes and insurance changed. Maybe you moved for work, went through a divorce, or inherited a house with a mortgage still on it. If there isn't enough equity to sell with an agent and walk away clean, a payment takeover may be the answer.
Here's what that means. We buy the house and take over the house payments on your current mortgage. The deed moves to us at a real closing with a Florida title company or attorney. The loan stays in your name until it's paid off or refinanced, and we make the payments from then on.
- Call or fill out the form. Tell us about the house and the loan balance.
- We review the loan. We look at your balance, rate, payment, taxes, insurance and any HOA.
- You get written terms. If it fits, we put the price, the payment plan and who pays what in writing.
- Close with a title company. You can have your own attorney review everything first.
If a payment takeover isn't the right fit, we'll say so and show you the other ways we can buy, like a straight cash offer.
Formal loan assumption vs. subject-to: what's the difference?
When people search "take over my mortgage payments," they usually mean one of two things.
| Comparison | Formal loan assumption | Subject-to purchase |
|---|---|---|
| Lender approval | Required | Not requested |
| Whose name is on the loan after | The buyer's (if the lender releases you) | Still yours |
| Who can do it | Mostly FHA, VA and USDA loans; most conventional loans don't allow it | Works with most loan types |
| How long it takes | Often 45–90+ days of lender paperwork | Set by the title company and the parties |
| Credit impact on you | Released, if the lender signs a release | Payments keep reporting on your credit, good or bad |
| Main risk | Lender can say no | The due-on-sale clause, and the buyer stopping payments |
If your loan is FHA or VA, ask your servicer about a formal assumption first. It's the cleanest option when it's available. We're happy to tell you if that's a better path than selling to us.
The due-on-sale clause and other risks, honestly
Most mortgages have a due-on-sale clause. It lets the lender ask for the full balance when the property is transferred. Lenders don't often use it while payments are current, but they can, and nobody can promise you they won't.
Other risks to know before you let anyone take over your house payments:
- Your credit stays tied to the loan. If a buyer misses a payment, it shows up on your report.
- Insurance must be redone. The homeowner's policy changes when title changes. This matters a lot in Volusia and Brevard, where wind and flood coverage is expensive.
- HOA rules. Many communities in Orange, Osceola and Lake County require notice of a sale and charge estoppel fees.
- You can't easily take it back. Once the deed is recorded, the house belongs to the buyer.
How we handle it: a licensed Florida title company or attorney closes every deal. The payment terms are in the closing documents. You keep online access to your loan, or we give you a way to check each payment. We encourage you to have your own attorney read everything. This page isn't legal or tax advice.

Who this fits, and who it doesn't
Usually a good fit: you're current or only a few months behind, the loan has a decent rate, and there's little or no equity.
Usually not a fit: the house is already in a scheduled foreclosure sale, the loan is in forbearance, or there's a lot of equity (a cash sale or agent listing will likely net you more). Behind and facing foreclosure? See how we help you avoid foreclosure.
Questions Central Florida homeowners ask
Can someone legally take over my mortgage payments in Florida?
Yes. Selling a house subject to the existing mortgage is legal in Florida when it's done with a proper deed and closing. It doesn't remove the lender's due-on-sale rights, which is why we explain that risk in writing first.
Do you take over house payments in Kissimmee, Sanford, Clermont, Daytona Beach and Melbourne?
Yes. We buy in Orange, Seminole, Lake, Osceola, Volusia and Brevard counties, including Orlando, Kissimmee, Sanford, Clermont, Daytona Beach, Melbourne and Palm Bay.
Will taking over my payments hurt my credit?
Not if every payment is made on time; your loan keeps reporting as usual. A late payment would hurt it, so ask any buyer how you'll be able to check payments.
What if I'm already behind on my mortgage?
We can sometimes catch up the missed payments at closing. If a foreclosure sale date is set, call right away so we can tell you honestly whether there's time.
What about my homeowner's insurance and HOA?
Your policy is replaced at closing, and we deal with HOA notice and estoppel fees. Coastal Volusia and Brevard homes may need new flood or wind coverage.
Is this better than a cash offer?
It depends on your equity. If you have equity, a cash offer is often simpler. If you owe close to what the house is worth, a payment takeover can let you sell without bringing money to closing. We'll show you both.
